These Terms of Service ("Terms") govern your use of the BuildIt Pro platform and website at builditpro.app (the "Service"), operated by BuildIt Pro ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your business.

2. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any unlawful purpose or to solicit others to perform unlawful acts
• Send unsolicited messages (spam) or violate any applicable anti-spam laws (CAN-SPAM, TCPA)
• Impersonate any person or entity, or falsely represent your affiliation
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to collect or store personal data about others without their consent

3. Your Data

You retain all rights to the data you input into the Service ("Your Data"), including lead information, client records, messages, and files. We do not claim ownership of Your Data. You grant us a limited license to use Your Data solely to provide and improve the Service.

You are responsible for ensuring that your collection and use of customer data complies with all applicable laws, including privacy and telecommunications regulations.

4. Subscription and Payment

The Service is offered on a monthly subscription basis. By subscribing, you agree to pay the applicable fees. Key terms:

• Subscriptions renew automatically each month unless cancelled
• You may cancel at any time; cancellation takes effect at the end of the current billing period
• No refunds are provided for partial months
• We reserve the right to change pricing with 30 days' notice
• Additional usage charges (SMS, email volume, phone numbers) may apply based on your plan

5. SMS and Communication Compliance

The Service enables you to send SMS messages, emails, and other communications to your leads and clients. You are solely responsible for:

• Obtaining proper consent before sending messages (as required by TCPA, CAN-SPAM, and similar laws)
• Honoring opt-out requests promptly
• Ensuring the content of your messages complies with applicable laws
• Maintaining records of consent where required

Violation of communication laws may result in immediate suspension or termination of your account.

6. Service Availability

We strive to maintain high uptime but do not guarantee that the Service will be uninterrupted, secure, or error-free. We may perform scheduled maintenance with reasonable notice. We are not liable for any downtime, data loss, or damages resulting from service interruptions.

7. Intellectual Property

The Service, including its design, features, code, and documentation, is owned by BuildIt Pro and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service. The BuildIt Pro name, logo, and branding are our trademarks.

8. Third-Party Integrations

The Service may integrate with third-party platforms and services. We are not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party integrations is subject to their respective terms and policies.

9. Limitation of Liability

To the maximum extent permitted by law, BuildIt Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising out of or relating to your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless BuildIt Pro, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your account if you violate these Terms or if we reasonably believe your use poses a risk to the Service or other users. Upon termination, you may request an export of Your Data within 30 days. After 30 days, we may delete Your Data.

12. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Utah.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance. If you disagree with updated Terms, you may cancel your account.
